As explained in Section I, there are certain advantages to having a retirement plan be designated as "qualified." However, to be deemed "qualified" the plan must meet certain requirements established by federal law. For example, qualified plans may not discriminate unfairly in favor of highly paid employees and plan participants must become permanently entitled (i.e., vested) to their accrued benefits on a reasonable basis. This section explores the essential requirements of qualified retirement plans.
