Bait & Switch

Bait-and-switch (or "back-door") marketing is a deceptive practice in which CDs offering attractive yields are advertised to conservative investors, typically seniors, and then the seller attempts to switch interested prospects to buying fixed or variable annuities.

Pretext Interviews

Insurance advisers may not use pretext interviews to obtain information for an insurance transaction. "Pretext interviews" are interviews where an agent tries to get information about a prospect using the following acts:

  1. Pretending to be someone he or she is not.
  2. Pretending to represent a person he or she is not representing.
  3. Misrepresents the true purpose of the interview.
  4. Refusing to identify himself or herself upon request.

Acts one through three are inherent in the operation of Trust Mills (described on the next screen). Insurers and advisers found using those practices will be sanctioned under state insurance law.
