Any advertisement or other device designed to produce leads based on a response from a potential insured age 65 or older must prominently disclose that an agent may contact the applicant if that is the fact. An agent who acquires a person's name from a lead generating device must disclose that fact in the first contact.

Ads may not use words, letters, initials, symbols, or other devices that are misleadingly similar to those used by governmental agencies, non-profit or charitable institutions, senior organizations (such as AARP), or other insurers.

Fines & Penalties

Anyone violating this section is subject to fines and penalties levied by state insurance commissioners.
